The website www.fellody.com is owned and controlled by Zokyo AG (‘Zokyo’ or ‘we’, ‘our’ or ‘us’). We at Zokyo fully respect your privacy and put every effort in protecting any information you provide to us. This privacy policy is intended to inform you about how information about you is collected, used and disclosed by Zokyo, its subsidiaries and affiliates. With this policy we hope to remove any concerns you may have regarding this topic.

Before we start off, we want you to keep one thing in mind:

Fellody is a social networking site, so first and foremost you as a member fill the community with content. You create your profile, fill it with information about yourself, pictures and videos and share this information with others. This means you make data concerning your person public. Please choose wisely which information you want to make public and consider your own privacy and personal safety when sharing your information with anyone. We make every effort to protect your data technically. This policy applies to all websites (including fellody.com), products, applications, downloadable products and services offered by Zokyo wherever this policy is displayed. Although we try to keep you up-to-date on all changes made to the website, this policy may be updated from time to time without notice to you. It is your responsibility to read the policy carefully and review any changes that may have been made.
Minors under the age of 16 are not eligible to use our service and must not attempt to register at fellody and/or submit any personal information to us. Young people between 16 and 18 should not send any information about themselves to us without asking their parents/legal guardians for permission beforehand. If we become aware that anyone under the age of 16 has registered with us, we will take steps to terminate that person’s account and delete their profile information. If we do delete a profile we may retain your email and IP address to ensure that you do not try to create a new profile.

We are based in Switzerland, as such the collection, processing and use of personal data by Zokyo is addressed to the applicable data protection laws of Switzerland. For your convenience we provided translated copies of this privacy policy. Please note that In the event there is a discrepancy between this English language version and any translated copies, the English version shall prevail.

1.Information we collect

1.1Information provided by you
In order to join the fellody community you need to complete our online registration, where you have to provide us with information about you including your name, username, password, your email address, your date of birth, your gender, your flirting preferences and your location details. In your profile settings you have the opportunity to provide other details about yourself, but these are optional. Nevertheless we want to encourage you to provide us with these information because it will definitely improve your experience with our website. If you decide to sign up for a premium account we collect the financial information necessary to process your payments depending on your chosen payment method. Zokyo does not store any credit card or other payment card details, only our payment service providers do so and they are approved to do so by all applicable regulatory bodies.

All these details are available to you at any time on your ‘Profile’ page. Here you can correct or update your information at any time, except your username.

1.2Information we collect automatically
There is some information our servers automatically record as you access fellody. Your browser sends this information every time you visit a website, which includes your IP address, browser type, operating system, Internet service provider, the site from which you came and the site to which you are going when you leave our website, date and time stamp and one or more cookies that may uniquely identify your browser or your account. When you access our Services using a mobile device, we may receive or collect your mobile device ID (often referred to as UDID), mobile carrier, device manufacturer and phone number. In order to improve and administer our website and services we also collect information about your usage of, and activity on, fellody. With this information we are able to learn more about our user base and can offer you a more personalized experience with our services.

1.3How the information is collected

1.4The fellody client
The easiest and best way to get matches on fellody is to download and install our fellody client. If you do so, it will check the XML file of your iTunes or Windows Media Player and will send certain information about your listening habits, such artists, genre or play counts, to the fellody server. Here it will be stored and analyzed to determine your taste in music. The fellody client cannot and will not collect and transfer any other information than information regarding your listening habits. However, please notice that Zokyo cannot be liable for any damage which may occur to your computer as a result of downloading and using the client, nor shall it be liable for any invasion of privacy related to the same.

From time to time it may be necessary to upgrade the client to a newer version in order to offer you the best experience with fellody. If these modifications affect your privacy, we will endeavor to notify you and we will update this privacy policy accordingly.

1.5Advertisement by third party companies
On fellody you will find ads and offers by other companies than Zokyo, so called third party companies. Any of these advertisers or advertising networks my also use cookies and other tracking technologies. Zokyo does not control any third parties whose website that may be linked from our site. Their tracking technologies are governed by their own privacy policies and are not subject to this policy. Please review the privacy statement of the entities placing the links.

1.6Facebook Application
You may have already heard about our fellody application on facebook. When you use this app you permit Zokyo access to certain information from your facebook-profile. Which information is accessible depends on the privacy settings you established at facebook. When you first start using our app a pop-up will open which tells you which information is collected. By accepting our application you authorize Zokyo to collect, store, retain and use this information

2.Restrictions and Minors

A membership at fellody is restricted to natural persons. Minors under the age of 16 are not eligible to use our website and must not register and/or submit any personal information to us. Therefore we don’t knowingly collect any personal information from persons under the age of 16. In case we notice that we have collected personal data from a person under the age of 16, we will delete this information as quickly as possible. If you have reason to believe that this has occurred, please contact us at info@fellody.com, and we will delete all relevant information. For young people between the ages of 16 and 18 their parents /legal guardians are responsible to protect their privacy.

3.Third Parties

Zokyo will by no way sell or rent any of your personal information to other parties. We will only disclose aggregated non-personal data for marketing and promotional purposes, which cannot be used to identify you. We may share this information together with other information including log data with third parties for analysis, demographic profiling and targeted advertising.

Regarding targeted advertising, we use third-party advertising companies, such as google adsense, to serve ads when you visit fellody. These companies may use information about your visits to this and other websites in order to provide advertisements that may be of interest to you. Zokyo is located in Switzerland, but we understand fellody as a global website. Therefore our servers are located in different countries around the world. By submitting your personal information or using the fellody client you agree to the transfer of your personal information to, and storage and processing of your personal information in, any such countries and destinations.

Zokyo takes reasonable measures to help protect your personal information in an effort to prevent loss, misuse and unauthorized access, disclosure, alteration and destruction.

Zokyo has implemented reasonable and appropriate security measures to protect and prevent the loss, misuse and unauthorized access, alteration, disclosure and destruction of your personal information. Therefore we use reasonable security measures such as secured servers using firewalls. Your security is very important to us, so we work hard to ensure your secure use of our website and services.
